Terms & Conditions
Last updated: 16 August 2026
1. About Second Yes
Second Yes is a trading name of Amazura Global LLC, a Wyoming limited liability company.
Amazura Global LLC operates the Second Yes website and online store, including the information, products, features, tools and services available through it (collectively, the “Services”).
In these Terms, references to “Second Yes,” “we,” “us” or “our” mean Amazura Global LLC trading as Second Yes.
Our legal and contact details are provided at the end of these Terms.
The Second Yes store is powered by Shopify.
2. These Terms
These Terms govern your use of the Services and purchases made through Second Yes.
When you place an order, you agree that your purchase is subject to:
-
These Terms & Conditions
-
Our Refunds & Returns Policy
-
Any product-specific terms or specifications shown or confirmed before purchase
Our Privacy Policy explains how personal information is collected and processed. It does not form a waiver of any privacy rights you may have under applicable law.
If mandatory law applicable to you provides rights or protections that are more favourable than these Terms, those rights and protections will apply.
3. Eligibility and Accounts
You must have legal capacity to enter into a purchase contract in your jurisdiction.
If you create a customer account, you are responsible for keeping your login credentials secure and for information submitted through your account.
You must provide accurate, current and complete information when placing an order, including billing, shipping and contact information.
Please notify us promptly if information relevant to an existing order changes.
4. Products and Product Presentation
We take reasonable care to describe and present Second Yes products accurately.
Product colours may appear differently depending on your screen, device settings, lighting and display configuration.
Product images may also be styled, cropped, retouched or presented on different models or backgrounds for presentation purposes.
These presentation differences do not change our obligation to supply a product that conforms to the description, specifications and other requirements applicable to your purchase.
Product information may be updated or corrected for future purchases. Changes made after your order has been accepted do not retrospectively alter the product specifications agreed for your order.
Nothing in this section excludes any rights you may have if a product is faulty, incorrectly supplied, materially different from its description or otherwise does not conform to applicable consumer law.
5. Standard and Custom Made Items
Second Yes sells both Standard Items and Custom Made Items.
Standard Items
A Standard Item is ordered from fixed options offered by Second Yes.
This may include:
-
Published standard sizes
-
Published colour options
-
Fixed product variations
-
Standard accessories or add-ons
An item does not become Custom Made merely because it is produced after you place your order.
Custom Made Items
A Custom Made Item is produced according to individually agreed customer requirements.
This may include:
-
Customer-specific body measurements
-
Individually requested construction changes
-
Individually requested design variations
-
Non-standard colours or specifications
-
Other individually agreed personalisation
Where an item is Custom Made, that classification will be determined by the options or specifications agreed for your order.
Return and cancellation rights relating to Standard and Custom Made Items are explained in our Refunds & Returns Policy.
6. Measurements and Custom Made Orders
Where you provide measurements or other information for a Custom Made Item, you are responsible for ensuring that the information supplied is accurate.
Please check all measurements and specifications carefully before confirming them.
Once Custom Made specifications have been confirmed and production has commenced, changes may not be possible.
Where an item has been correctly produced according to customer-provided or customer-approved measurements, a fit issue caused solely by inaccurate measurements supplied to us does not constitute a manufacturing fault.
This does not affect your rights where:
-
We fail to follow the confirmed measurements or specifications
-
The product has a construction or manufacturing fault
-
The item materially differs from what was agreed
-
Applicable consumer law provides another remedy
7. Orders and Contract Formation
When you submit an order, you are making an offer to purchase from Second Yes.
Receiving an automated acknowledgement that we have received your order does not necessarily mean that the order has been accepted.
A contract is formed when Second Yes confirms acceptance of the order or otherwise communicates that the order has been accepted for fulfilment.
Payment may be authorised or collected as part of the ordering process. If we decline an order after payment has been collected, the relevant amount will be refunded.
We may decline an order where reasonably necessary, including where:
-
A product is unavailable
-
We cannot fulfil the requested specification
-
Payment cannot be authorised
-
There is a reasonable fraud or security concern
-
Delivery is unavailable to the requested location
-
There is an obvious material pricing or listing error
-
Accepting the order would breach applicable law
Where we cannot accept an order, we will notify you using the contact information provided.
8. Order Changes and Cancellation
Please review your order carefully before submitting it.
Standard Items
If you wish to cancel or change a Standard Item before dispatch, contact us as soon as possible.
Where applicable consumer law gives you cancellation or return rights after an order has been accepted, those rights are not removed merely because preparation or production of a Standard Item has begun.
Custom Made Items
Please contact us immediately if you wish to change or cancel a Custom Made Item.
Changes or cancellation may not be possible once the individually specified item has entered production.
Further information is contained in our Refunds & Returns Policy.
9. Prices, Payment, Taxes and Import Charges
The price applicable to an order is the price displayed and confirmed during the ordering process, subject to correction of obvious errors as permitted by applicable law.
Prices may change for future orders without notice.
Shipping charges and taxes collected by Second Yes will be shown during checkout where applicable.
For international orders, customs duties, import taxes or other charges may apply depending on the destination country.
Where such charges are not collected by Second Yes and are payable separately by the customer, this will be handled in accordance with the information provided during the ordering process and applicable law.
You must use a payment method that you are authorised to use.
Payments may be processed by Shopify and other payment-service providers.
10. Production and Fulfilment
Some Second Yes products are produced after an order is placed.
Different products may therefore have different production and fulfilment times.
Products may also be manufactured, fulfilled or shipped by third-party production and logistics partners acting in connection with your Second Yes order.
Use of a third-party manufacturing or fulfilment partner does not change the fact that your purchase contract is with Amazura Global LLC trading as Second Yes.
Items within the same order may be produced or dispatched separately and may arrive at different times.
11. Shipping and Delivery
Production and delivery estimates shown on the Services are provided in good faith.
Unless a particular delivery date has been expressly agreed or is otherwise legally treated as essential, estimated dates are not guarantees.
Delays may occasionally occur because of circumstances such as carrier disruption, customs processing, weather, border controls or other matters outside our reasonable control.
We will not use this provision to exclude any delivery rights available to you under applicable consumer law.
Where applicable law requires delivery within a particular period, or provides you with cancellation or other remedies because delivery is late, those rights will apply.
UK and EU consumer law, for example, provides a default requirement for delivery without undue delay and ordinarily within 30 days unless another delivery period has been agreed. (Legislation.gov.uk)
Event Dates
If delivery by a particular date is essential—for example because the garment is required for a wedding or other fixed event—you should tell us before placing the order.
Where applicable consumer law treats an agreed or communicated delivery date as essential, your statutory rights concerning late delivery remain unaffected.
12. Risk of Loss
Where you are purchasing as a consumer, the product normally remains at Second Yes's risk until it comes into your physical possession or the physical possession of a person identified by you to receive it.
A different rule may apply where you independently commission a carrier that was not offered by Second Yes, where permitted by applicable law.
This replaces the Shopify template wording that transferred risk immediately upon handover to the carrier; that rule would be inconsistent with UK consumer law in ordinary trader-arranged delivery. (Legislation.gov.uk)
13. Returns, Refunds and Faulty Items
Returns, refunds, change-of-mind rights, Custom Made exclusions, return shipping and cancellation are governed by our Refunds & Returns Policy.
Nothing in these Terms or our Refunds & Returns Policy excludes any right or remedy that cannot legally be excluded.
If a product is faulty, damaged, incorrect, materially different from its description or otherwise non-conforming, remedies will be provided in accordance with applicable consumer law.
14. Intellectual Property
The Second Yes website and its original content, including brand materials, text, graphics, design elements, photographs, presentation imagery, video and other materials, are owned by or licensed to Amazura Global LLC except where otherwise stated.
Second Yes names, logos and other brand identifiers may also be protected by trademark and other intellectual property laws.
You may use the Services for your personal, lawful and non-commercial use.
Except as permitted by law, you may not reproduce, republish, distribute, commercially exploit or create derivative works from protected Second Yes content without permission from the applicable rights holder.
Shopify and third-party names, trademarks and content remain the property of their respective owners.
15. Third-Party Tools and Links
The Services may include tools, integrations or links provided by third parties.
Those third-party services may operate under their own terms and privacy practices.
Second Yes is not responsible for the independent operation, content or practices of third-party websites or services that we do not control.
Nothing in this section limits responsibility that applicable law places on Second Yes in relation to services we use to perform our obligations to you.
16. Relationship With Shopify
Second Yes is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases you make through the Second Yes store are made directly with Second Yes.
Shopify is not the seller of Second Yes products.
Your relationship with Shopify in connection with Shopify's own services may also be governed by Shopify's applicable terms and privacy policies.
I have retained the substance of this section because Shopify's original Terms specifically instruct merchants not to remove or materially alter the Shopify relationship provision.
17. Privacy
Personal information collected through the Services is processed in accordance with our Privacy Policy.
Because our store is powered by Shopify, Shopify also processes certain information in connection with providing its ecommerce platform and related services.
Our Privacy Policy explains our respective roles and your available privacy rights in greater detail.
18. Reviews and Feedback
If you submit a review, photograph, suggestion or other content to Second Yes for publication or use, you confirm that you have the right to provide that content.
You grant Second Yes a non-exclusive, worldwide, royalty-free licence to reproduce, display, publish and use that content in connection with operating, promoting and improving Second Yes, unless otherwise agreed.
You must not submit content that:
-
Infringes another person's intellectual property or privacy rights
-
Is unlawful, fraudulent or deliberately misleading
-
Contains malicious software
-
Impersonates another person
-
Is defamatory, abusive or otherwise unlawful
Where reviews or endorsements have been provided in exchange for an incentive, the incentive must be appropriately disclosed.
19. Prohibited Uses
You may not misuse the Services.
This includes using the Services to:
-
Break applicable law
-
Commit fraud
-
Infringe intellectual property rights
-
Introduce malware or malicious code
-
Interfere with website security or operation
-
Access accounts or data without authority
-
Scrape or harvest personal information unlawfully
-
Impersonate another person
-
Submit deliberately false or misleading information
-
Harass or threaten others
We may restrict or suspend access where reasonably necessary to protect Second Yes, Shopify, customers, third parties or the security of the Services.
Suspension of website or account access does not remove rights relating to an existing purchase.
20. Website Availability
We take reasonable steps to keep the Services available and accurate.
We do not guarantee that the website will always operate without interruption or technical error.
Temporary interruption may occur because of maintenance, security issues, third-party service interruptions or circumstances outside our reasonable control.
This section relates to operation of the website and does not disclaim statutory warranties or consumer rights relating to products purchased from Second Yes.
21. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms is intended to exclude or restrict:
-
Mandatory consumer rights
-
Liability for fraud or fraudulent misrepresentation
-
Liability for death or personal injury where it cannot lawfully be excluded
-
Liability that applicable law otherwise prohibits us from limiting
Where permitted by law, Second Yes is not responsible for losses that were not reasonably foreseeable as a consequence of our breach.
Where you purchase exclusively as a consumer, we are not responsible for losses relating purely to commercial or business activity that were not part of the consumer transaction.
Any limitation in these Terms applies only to the extent permitted by applicable law.
This is deliberately much narrower than Shopify's existing clause, which attempts to disclaim essentially all direct, indirect and product-related losses. Consumer statutes can make broad exclusions ineffective or unfair. (Legislation.gov.uk)
22. Events Outside Our Reasonable Control
We are not responsible for delay caused solely by circumstances outside our reasonable control where the law permits this.
Where such an event materially affects our ability to fulfil an order, we will take reasonable steps to communicate with you and minimise the effect of the disruption.
This provision does not remove any cancellation, refund or other rights you have under applicable law.
23. Errors and Corrections
We may correct typographical errors, technical errors or inaccurate information on the Services.
Corrections to website information apply prospectively and do not remove contractual or statutory rights relating to an order that has already been accepted.
Where an obvious pricing or product-listing error affects an order, we will contact you and deal with the order in accordance with applicable law.
24. Governing Law and Consumer Rights
These Terms and contracts with Second Yes are governed by the laws of the State of Wyoming, United States, except to the extent that mandatory law applicable to a consumer requires otherwise.
Nothing in this choice of law is intended to deprive a consumer of mandatory protections available under the law that applies to them and which cannot lawfully be excluded by contract.
This qualification is important for international sales. Under the EU's Rome I framework, for example, an applicable choice-of-law clause cannot deprive qualifying consumers of mandatory protections of their habitual residence. (EUR-Lex)
The courts of Wyoming may have jurisdiction over disputes involving these Terms.
However, this does not prevent a consumer from bringing or defending proceedings in another court where applicable consumer or jurisdictional law gives them that right.
25. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, business practices or legal requirements.
The current version will be published on the Second Yes website with an updated revision date.
Changes will not retrospectively alter an existing purchase contract unless permitted by applicable law or agreed with you.
Where applicable law requires notice of a material change, we will provide that notice.
26. Severability and Waiver
If any provision of these Terms is found to be invalid or unenforceable, the remainder of the Terms will continue to apply to the extent permitted by law.
If we do not immediately exercise a right under these Terms, that does not necessarily mean that we have waived that right.
